SAN DIEGO (AP) - A woman convicted along with her brother in the killing of their stepfather in his San Diego County home is asking a judge to change her sentence so she might someday have a chance at freedom.

Brae Hansen, now 25, was sentenced to life in prison without the possibility of parole for the murder of Timothy MacNeil, a San Diego attorney.

U-T San Diego reported Wednesday (https://bit.ly/Y8PCcv ) that Hansen argued her current term violates her constitutional rights because she was a minor at the time she committed murder.

An appellate court agreed, and the case has been sent back to Superior Court. No new hearing date has been set.

She was 19 when she went to trial in 2009 alongside her then-20-year-old brother, Nathaniel Gann. Both were convicted of murder.
