HAVRE, Mont. (AP) - Closing arguments were scheduled Tuesday in the case of a Havre man charged with deliberate homicide in the shooting death of his younger brother.

Prosecutors allege Shane Johnson shot Travis Johnson in the basement of their parents’ house during a drunken argument last November.

Shane Johnson said his brother punched him in the nose in the living room and tried to push him down the stairs into the basement. He said Travis Johnson grabbed his gun and the two men were fighting over it when it went off.

Prosecution witnesses said there was no sign of struggle going down into the basement. They said Shane Johnson’s blood was on the zipper pull of his gun case and on an envelope that was inside, meaning he was the one who grabbed the gun.
