NEW CASTLE, Pa. (AP) - A 17-year-old boy has been jailed in the fatal shooting of his alleged accomplice in a burglary, even though the victim was shot by the homeowner.

State police Sgt. Steve Driscoll says Anthony Welsh, of New Castle, is responsible for 20-year-old Mariek Payne’s death because Payne was killed - though not by Welsh - during the commission of a felony.

Police say Welsh and Payne broke into a Union Township home on Friday, and that Payne was shot by a person who lived there as Payne and Welsh fled.

Payne’s body wasn’t found until 4 p.m. Sunday in an alley near his home in the township. That’s near New Castle, about 45 miles northwest of Pittsburgh.

Online court records don’t list an attorney for Welsh who faces an Oct. 9 preliminary hearing on second-degree murder and lesser charges.
