HARRISBURG, Pa. (AP) - A federal judge has declined to dismiss a lawsuit by the mother of a man shot and killed by police during gunfire at a central Pennsylvania social club.

The suit was filed by Everlidis Bonilla in the death of 21-year-old Juan Bonilla at the Veterans Political Association in York in November 2012.

Police said York and West Manchester Township officers fired 22 shots at Bonilla as he fired at another man. York County prosecutors cleared both officers of wrongdoing.

PennLive.com (https://bit.ly/1CLphRw ) reports that Senior Judge Sylvia Rambo dismissed the lawsuit’s punitive damage claims against the city and township but allows such damages to be sought against the officers.

The judge also retained the city and township as defendants along with the officers but removed both police departments as defendants.
