CHARLES CITY, Iowa (AP) - An attorney for a man convicted of first-degree murder and sexual assault in the killing of his former girlfriend’s 5-year-old daughter is seeking a retrial.
Defense attorney Aaron Hawbaker filed a motion for a new trial of 35-year-old Casey Frederiksen. Jurors found Frederiksen guilty in March of sexually abusing and stabbing to death Evelyn Miller while babysitting her in 2005. Her body was found in the Cedar River days after she was reported missing.
Hawbaker argues that the judge presiding over the trial erred in allowing child pornography found on Frederiksen’s computer to be used as evidence. He also says the jury returned verdicts that defy state law, “as there was no physical evidence connecting the defendant to the crime.”
It’s unclear when a judge will rule on the request.
