CHASKA, Minn. (AP) - A Norwood Young America man who was shot by a McLeod County deputy has been charged with assault and drunken driving.

Authorities say 23-year-old Michael Thomas Montgomery is accused of tackling and assaulting Deputy Matthew Wyatt, who was off duty when he tried to stop an intoxicated Montgomery from driving away from a gas station April 17 in Norwood Young America.

Wyatt, who suffered a concussion and other injuries, got off one shot that struck Montgomery in the arm.

Carver County Attorney Mark Metz said Friday that the deputy was justified in shooting Montgomery and won’t be charged.

Montgomery’s first court appearance is set for Sept. 4. Online court record don’t list an attorney who could comment on his behalf.
