PHOENIX (AP) - Prosecutors plan to seek the death penalty if a Goodyear man is convicted of killing his wife earlier this year.

John Leo Davis is accused of fatally stabbing his wife Michele in March.

He pleaded not guilty to charges of first-degree murder, child abuse and disorderly conduct and is being held on a $2 million bond.

Prosecutors allege that the 38-year-old Davis committed the offense in an especially heinous, cruel or depraved manner.

There reportedly were seven children in the house at the time of the killing and court records show one of them called 911.

Davis’ trial is scheduled to begin on Dec. 8 in Maricopa County Superior Court.
