ALBANY, N.Y. (AP) - An 18-year-old upstate New York man arrested for gun possession is also facing a murder charge.

Albany Police say Ismael Ayala allegedly tossed a loaded 9-millimeter handgun as he ran by a church Wednesday night, but he was soon apprehended and the weapon was retrieved.

The Albany Times Union reports (https://bit.ly/1TWyKkq ) that after a further investigation Ayala was also charged in connection with the death of Jorge Falu-Garcia. Police say Ayala shot the 25-year-old man last October. The victim died at Albany Medical Center.

Ayala is charged with second-degree murder and second-degree criminal possession of a weapon. He was arraigned and sent to Albany County Jail. It could not be immediately determined if he has an attorney.
