DOVER, Del. (AP) - The Delaware Board of Pardons has rejected a commutation request from a former death row inmate now serving life in prison for raping and strangling a 92-year-old woman in the home she shared with her invalid husband.

Frank C. Whalen Jr. was convicted of killing Elva Kemp of Clayton in 1977. He was sentenced to life in prison after his 1978 death sentence was overturned.

Whalen recently filed a commutation request with the pardons board, but the panel did not find the petition worthy of a hearing at its meeting Thursday.

The board similarly refused to hear the commutation request of another convicted killer, Jeffrey Fogg.

Fogg and a co-defendant were convicted of beating and stomping a New Castle County man to death in 1995.
