ELIZABETH, N.J. (AP) - A dockworker has pleaded not guilty to a death by auto charge stemming from a fatal accident at a shipping terminal in Elizabeth.

Victor Belo entered his plea Monday during a brief hearing in Elizabeth.

Union County prosecutors say the 48-year-old North Arlington man was legally drunk when the top loader he was operating struck and killed a colleague. He could face up to 10 years in prison if convicted.

Belo remains free on $75,000 bail.

The charge stems from an Aug. 7 accident at the APM Port Elizabeth terminal. Authorities say the top loader struck Judy Jones, a 49-year-old Newark resident who was pronounced dead at the scene.

Prosecutors say Belo’s blood-alcohol level was over the legal limit of 0.08 percent at the time.
