MILWAUKEE (AP) - Milwaukee County prosecutors are considering whether charges are warranted in the death of an infant who was being cared for by an unlicensed provider.

Three-month-old Payton McCoy died June 30th while sleeping on an adult bed in Milwaukee. The day care provider told WISN-TV (https://bit.ly/1HqeZVW ) she put the baby on a bed with a cushion to keep him from rolling over. When she went to check on him she found him face down against the wall.

State law requires a license for anyone who cares for four or more children under age 7 who are unrelated to the caregiver. The state says Payton’s caregiver was also caring for eight other children under seven.

A Milwaukee County medical examiner’s report says the caregiver told investigators she thought the state had too many restrictions and she did not agree with them.
