CARMEL, N.Y. (AP) - A judge has dismissed charges against a former Putnam County police officer accused of beating a shackled prisoner.

Acting Westchester Supreme Court Justice Robert Neary said in a decision dated Monday that the grand jury was not properly instructed in the Patrick Castaldo case.

The Journal News (https://lohud.us/1W5oJzX ) reports that Putnam District Attorney says he’ll appeal.

Castaldo was indicted in February on charges he allegedly put a shackled prisoner in a chokehold and beat him last summer. He’s a retired Putnam County sheriff’s investigator.

The charges stemmed from the arrest of Kenneth DeFreitas on suspicion of robbing a bank and a supermarket. He was paid $35,000 by Putnam County last year after he filed a notice of claim, alleging police brutality.
