BURKE, S.D. (AP) - The Charles Mix County state’s attorney says he’s sworn off alcohol since his arrest earlier this year for driving under the influence.

Scott Podhradsky says he hasn’t had a drink of alcohol since his arrest in August. He was sentenced Tuesday to 30 days in jail with credit for one day served and the rest of the time suspended. He also paid $640 in fines and court costs, and lost his driver’s license for a month.

“Right when it happened, I took steps to make sure it would never happen again,” Podhradsky told the Daily Republic (https://bit.ly/1luCN8u ). “This was not something I just brushed off. The time between the guilty plea and sentencing was so I could get the care I needed. I took this very seriously.”

Authorities have said Podhradsky in August somehow ended up beneath a motorcycle he had been riding. Court records show he was able to get from under the motorcycle, but appeared unstable as he tried to stand up. He reportedly admitted to have been drinking vodka and told police he was on his way to Colorado.

The police report in the case shows Podhradsky, 54, couldn’t remember how the incident at the Hillcrest Motel in Burke happened. He registered a blood alcohol content that was more than three times the legal limit of 0.08.

“If you get on the back of a motorcycle with that alcohol level, you probably should be done,” Podhradsky told the newspaper. “If anybody drives with that alcohol level on the back of a motorcycle, you’re dumb. You need to stop and reassess what you’re doing in life, otherwise you’re not going to be around much longer.”

Podhradsky, who began his second stint as the Charles Mix County state’s attorney in January, said he has already completed a court-ordered intensive outpatient treatment program.
