SAN ANTONIO (AP) - An off-duty San Antonio police officer will not be charged in the fatal shooting of an armed man during a dispute at the drive-thru window of a restaurant.

A Bexar (bayr) County grand jury on Wednesday declined to indict anyone in the February 2014 death of Marquise Jones.

Investigators say Jones was riding in a vehicle that may have bumped with another in the drive-thru area.

Authorities say Officer Robert Encina initially spoke with the driver of one of the vehicles and told him to turn off the engine. A police statement says that vehicle’s front passenger then got out and flashed a gun.

Encina shot Jones, who died at the scene.
