WILMINGTON, Del. (AP) - A federal judge has issued a preliminary injunction in a trademark infringement lawsuit filed by the Cracker Barrel restaurant company against a Dewey Beach business.

The injunction signed Thursday prohibits Highway I Limited Partnership and its business partners from continuing any exterior work on the new Jimmy’s Grille in Rehoboth that resemble Cracker Barrel’s trade dress, marks or designs.

The judge’s order also requires the defendants to remove, cover or modify certain parts on the exterior of Jimmy’s Grille within the next 15 days.

Cracker Barrel attorneys have alleged that the design for the Jimmy’s Grille restaurant and gift shop copies and misappropriates the distinctive look of Cracker Barrel restaurants.

At the direction of the judge, attorneys for both sides agreed on the preliminary injunction following a court hearing Wednesday.
