MONTGOMERY, Ala. (AP) - A judge has ruled that Montgomery officials cannot be dismissed from a wrongful-death lawsuit involving a baby who was born in the city jail.

The Montgomery Advertiser reports (https://on.mgmadv.com/1MmgMh8 ) that Circuit Judge Greg Griffin made the ruling Friday evening. A complaint says the newborn baby’s mother, Jenny Newman, was serving a 30-day sentence in August 2013 on misdemeanor charges when she became ill and requested medical care.

The complaint says help never came after Newman gave birth to her son in the City of Montgomery Municipal Jail. The boy lived only a few minutes.
