COEUR D’ALENE, Idaho (AP) - A northern Idaho judge has kept bail at $100,000 for a male caretaker charged with sexually abusing a 102-year-old woman at a Spirit Lake area assisted-living facility.

Fifty-year-old Phillip R. Smalley of Spirit Lake is also charged with misdemeanor abuse or neglect of a vulnerable adult involving an 82-year-old woman who has since died.

The Coeur d’Alene Press reports (https://bit.ly/1me1w0L) that 1st District Court Judge Lansing Haynes made the decision Friday.

Smalley’s defense attorney asked that Smalley be released on his own recognizance, but prosecutors say Smalley is a threat to the community.

Smalley has pleaded not guilty and says the touching was appropriate and within the scope of his duties.

A jury trial is scheduled for Jan. 19.
