PHOENIX (AP) - The Arizona Supreme Court in January will discuss a lawsuit seeking the ouster of a state utility regulator and has ordered sides in the case to file legal briefs in the meantime.

Attorney General Mark Brnovich on Monday filed a lawsuit directly with the high court asking that Corporation Commission member Susan Bitter Smith be removed from office because she is a registered lobbyist for cable companies regulated by the commission.

Bitter Smith says she works for non-regulated cable companies, not for telephone companies regulated by the commission.

The Supreme Court agreed Wednesday to take up the matter quickly and said it will discuss the case during a Jan. 5 closed-door meeting. It ordered lawyers for Bitter Smith and Brnovich to file briefs by Dec. 16 and Dec. 23, respectively.
