BOULDER, Colo. (AP) - The family of a man who was killed by Boulder police in 2013 is suing the city, police department and officer who pulled the trigger claiming police used excessive force and were improperly trained.

The Daily Camera reports (https://bit.ly/1N3KbhV ) that the family of Michael Habay filed a lawsuit in U.S. District Court in Denver last week saying police overreacted and that Habay died because he had mental health issues.

Officers fatally shot 41-year-old Habay at his apartment on Nov. 24, 2013, after a neighbor reported that he was armed with knives and stabbing things.

Boulder officials say officers acted appropriately but that they could not comment further on the lawsuit.
