BUTTE, Mont. (AP) - A 48-year-old Texas man has pleaded not guilty to deliberate homicide and two other felonies related to a triple shooting in Montana that left one man dead.

The Montana Standard reports (https://bit.ly/1NHuCgb) Tony Dwade Sawyer of Lubbock was arraigned in Butte district court on Thursday. He could face the death penalty if convicted.

Sawyer said didn’t kill 37-year-old Joe Powers and injure two other men in a shooting spree on Nov. 3. Police say Sawyer fled the scene and they arrested him in Idaho the next day.

He remains held in the Butte jail with bail set at $1 million.

Sawyer’s public defender, Ed Sheehy, says he will provide a notice of his client’s justifiable use of force before his Jan. 21 hearing. amount.
