VON ORMY, Texas (AP) - A Texas trooper has fatally shot a driver during a struggle after the convicted felon said he had a weapon in his car.

The Texas Department of Public Safety on Thursday said Allen Anthony Pacheco of Poteet (poh-TEET’) had a shotgun. Convicted felons are not allowed to possess firearms.

A trooper, whose name wasn’t released, was patrolling Wednesday night near Von Ormy when he stopped a car with a broken taillight.

Trooper Jason Reyes says Pacheco got out, was evasive and finally said he was a felon with a weapon. Reyes says the trooper and Pacheco struggled. A Taser failed to subdue the suspect. Pacheco was shot while trying to climb back into his car.

The trooper is on paid administrative leave.

DPS declined to release details on Pacheco’s criminal history.
