WINSTON-SALEM, N.C. (AP) - A former day care teacher is refusing to testify in a lawsuit that says that she physically abused a 5-year-old boy until the criminal charges filed against her are resolved.

The Winston-Salem Journal reports (https://bit.ly/1jCH9sg) Jacinta Gladden faces several charges, including negligent child abuse inflicting serious injury, stemming from a June 17 incident. Arrest warrants say Gladden slid a child across the floor at Sugar and Spice Child Enrichment Center and held him while telling another child to strike him.

The child’s parents filed a lawsuit Aug. 25 against Gladden and the day care.

John Vermitsky, the attorney for the plaintiffs, has sought to have Gladden come in for a deposition. Gladden’s attorneys say she couldn’t participate in the deposition because the criminal charges were pending.

Vermitsky says Gladden waived her Fifth Amendment rights in September.
