STOCKTON, Calif. (AP) - Authorities say the 3-year-old stepson of a California Highway Patrol officer shot and injured his teenage brother after gaining access to a gun in his family’s Stockton home.

The 15-year-old boy was shot in the foot Saturday night. He was treated at a hospital for an injury that was not life-threatening and is expected to recover.

Police say the brothers had been playing a game of hide-and-seek when the 3-year-old found the officer’s .22-caliber rifle in a closet and then shot his brother. The name of the officer has not yet been released.

The CHP is continuing to investigate the shooting.

Stockton police have handed the case over to the San Joaquin County District Attorney’s Office to determine if charges will be filed.
