PIERRE, S.D. (AP) - Gov. Dennis Daugaard says he believes wagering on daily fantasy sports should be considered gambling under South Dakota law.

Daugaard told The Associated Press on Monday that he thinks fantasy sports is “no more a game of skill than blackjack is a game of skill.”

An industry representative told the state Commission on Gaming last month that fantasy sports is predominantly based on skill rather than chance, making it legal in South Dakota.

Attorney General Marty Jackley says he doesn’t plan to seek felony indictments over daily fantasy sports wagering without a clear directive from the Legislature.

Jackley says he would like state lawmakers to provide a clearer definition of where daily fantasy sports wagering falls under state law.

Daugaard says he anticipates weighing in on the topic.
