WINSTON-SALEM, N.C. (AP) - A Forsyth County judge has refused to dismiss a lawsuit by the parents of an 11-year-old boy killed two years ago while crossing the road to catch a school bus.

The Winston-Salem Journal reported (https://bit.ly/1vCpcji) that the family of Hasani Wesley sued in December, saying the school board failed to adequately protect their son by having appropriate bus routes and properly supervising the bus driver.

The boy was died Dec. 19, 2012, after he was hit by a vehicle while crossing a road to catch the school bus he had missed. The bus had turned around and was coming back to get him when he was hit.

Judge Patrice Hinnant on Monday rejected the school board’s request to dismiss the lawsuit.

No trial date has been set.
