LIBERTY, N.Y. (AP) - State police say a man is in critical condition after he was shot by another man during a fight at an upstate New York gas station.

Troopers say the shooting occurred around 6:30 p.m. Monday at the Mobil Gas station in the Sullivan County town of Liberty, 75 miles southeast of Albany.

Police say 30-year-old Balsey DeWitt of Livingston Manor fired multiple rounds at a 31-year-old man, also from Livingston Manor, while they were apparently fighting over a woman.

Troopers say the victim is in critical condition at a local hospital. His name hasn’t been released.

DeWitt was charged with assault, criminal possession of a weapon and criminal use of a firearm.

He’s being held in the county jail. It couldn’t be determined if he has a lawyer.
