NORFOLK, Va. (AP) - A jury has deadlocked for the second time in the trial of a Norfolk man charged in a shooting death at a pharmacy.

The Virginian-Pilot (https://bit.ly/1An4x4o) reports a circuit court judge declared a mistrial Friday in Bernell Benn’s voluntary manslaughter case.

Benn was charged in the August 2012 death of Ramon Colorado.

In an interview shortly after his arrest, Benn told the newspaper he was picking up medicine when Colorado cut in front of him. The two argued, and Colorado sprayed Benn with pepper spray. Police said Benn then fired a handgun at Colorado, who pulled a gun and returned fire, hitting Benn in the shoulder.

A mistrial in the case also was declared last February.

Norfolk Commonwealth’s Attorney spokeswoman Amanda Howie says the office is evaluating its options.
