HARRISBURG, Pa. (AP) - A DUI lawyer has lost his driver’s license for 18 months for refusing a breath test even though he won his criminal case.

Lawyer Daniel Hargrove of Pittsburgh says he was having a diabetic episode when he was stopped driving 10 miles per hour in his Smart car.

A Commonwealth Court ruling Monday upholds the Pennsylvania Department of Transportation’s decision to suspend his license.

Defense lawyer Carl Parise (puh-REES) says his client should have been given a blood or urine test because of his medical condition. But it’s not clear Hargrove requested one after the August 2012 stop.

The 52-year-old Hargrove was acquitted in criminal court of both DUI and refusing the breath test.

Parise says the 18-month suspension factors in Hargrove’s earlier DUI in 1992.
