DOVER, Del. (AP) - U.S. Supreme Court has refused to hear James E. Cooke Jr.’s appeal of his conviction and death sentence for killing a University of Delaware student.

The News Journal of Wilmington reports (https://delonline.us/1y5qN1C) that the court on Monday declined to take Cooke’s case. Cooke was convicted of the 2005 rape and murder of 20-year-old Lindsey Bonistall of White Plains, New York.

A Delaware judge had set an execution date for Cooke last month, but another judge delayed the execution for his appeal to the nation’s highest court.
