DOVER, Del. (AP) - A judge has refused to find former Sussex County Councilman Vance Phillips liable in a lawsuit filed by a young woman who claims he sexually abused her.

The woman’s attorneys had asked the judge to find Phillips liable because he had not explicitly denied the allegations.

But the judge ruled last week that Phillips had properly invoked his right against self-incrimination. He also said summary judgment was improper because of the woman’s inconsistent statements.

The judge noted that the woman claimed in her lawsuit that she was a victim of rape, but denied being a rape victim when interviewed by police. She also admitted in a deposition that she told a detective that sex acts with Phillips were consensual.

The judge and attorneys will discuss a trial date next week.
