GARDEN CITY, Kan. (AP) - An arrest affidavit for a west Kansas woman accused of endangering her 11-year-old son by keeping marijuana around the house states the boy was able to draw a picture of the vaporizer she used to turn pot into cannabis oil.

The court document was released to The Wichita Eagle (https://bit.ly/1RRXQQy ) through an open-records request. It provides some insight into the state’s case against Shona Banda, a marijuana activist who said she used weed to treat a medical condition.

Banda, of Garden City, faces five charges related to marijuana use and child endangerment after her son talked about her drug use during an anti-drug program at school.

Her attorney, Sarah Swain, declined to comment Wednesday to the newspaper. In June, Swain said she believed the state illegally interviewed Banda’s son without the mother’s permission.

The Finney County District Attorney’s office has mostly remained quiet over the case.



“The affidavit speaks to the underlying basis for the charges filed,” said William Votypka, assistant Finney County attorney. “At this point, I don’t think we have anything else we want to talk about publicly.”

Much of the affidavit’s information comes from interviews of Banda’s son with Garden City police officers and social workers with the Kansas Department of Children and Families on March 24.

The affidavit states the boy had “unusual and specific knowledge regarding marijuana and its use.” He said his mother smoked marijuana every day with her 18-year-old son and his live-in girlfriend.

A judge granted a search warrant for Banda’s home, and officers collected around 500 grams of marijuana, multiple smoking pipes and three vaporizers, among other items, according to authorities.

Banda is scheduled for a second appearance in court on Aug. 24.
