DUBUQUE, Iowa (AP) - A Dubuque mother whose state cannabis card allows her to give oil extracted from marijuana to her epileptic son said she administers it in the parking lot of the boy’s care center because the facility doesn’t allow the treatment inside.

Jennifer McFadden said she gives the oil to her 12-year-old son twice a day in the parking lot, The Des Moines Register (https://dmreg.co/1CSgZv9 ) reported. She said Hills & Dales, the agency which operates the center, said it can’t allow the oil into the facility because federal authorities still consider it a strictly controlled marijuana product.

McFadden said she doesn’t blame Hills & Dales, which she called an excellent organization.

“I do believe them when they say they’re doing everything they can,” she said.

Hills & Dales CEO Marilyn Althoff told the newspaper that she couldn’t discuss the boy’s case but that in general, “we’re a licensed health care facility, and with that come federal regulations.”



CW Botanicals, the Colorado-based company that sends McFadden the oil, said its product isn’t technically a marijuana product, because it has almost none of the chemical that allows recreational marijuana users to experience a high. The company said the oil has instead a large amount of the chemical cannabidiol, which many families believe can reduce epileptic seizures.

Federal authorities have said they believe interstate distribution of the oil is illegal trafficking of a marijuana product, although they haven’t tried to block it so far. McFadden said she doesn’t expect to be prosecuted, but she’s willing to run the risk because she wants to see if the oil will help her son.

“In my opinion, I’m doing nothing wrong. The state of Iowa says I’m allowed to do this,” she said.
