July 28—NEWBURYPORT — Three days after his arrest for allegedly sexually assaulting a 13-year-old girl, a Salisbury man remains behind bars awaiting a hearing to determine whether affording him bail would present a danger to society and his alleged victim.

Christopher Poly, 46, of Cable Avenue, faces six counts of indecent assault and battery of a child under 14, after he was arrested Saturday on a warrant at a Broadway bar. Ordered held without bail after his arraignment yesterday at Newburyport District Court, he is due back for what is called a 58A, or dangerousness hearing, on Friday.

According to court documents, he allegedly assaulted his victim several times starting in November touching her breasts and genitals over her clothing. Sgt. James Leavitt’s report details her attempt to thwart his efforts.

“She stated that it would start out as roughhousing or play fighting, but then he would place both his hands on her breasts in a forceful manner. She stated that the first time he did it, she didn’t know what to do, but she had to force his hands away and he resisted her and overpowered her and continued to hold and squeeze her breasts,” Leavitt wrote in his report.

When asked how many times Poly touched her inappropriately, the victim told Leavitt between 15 and 20 times from November to February of this year. The victim told Leavitt that Poly would not force her to touch parts of his body, but at one point he stood beside her and took off his pants. She denied he ever showed her pornographic material.

According to Leavitt’s report, Poly would tell the alleged victim what he would do to his girlfriend sexually.

“There were also times that he would say sexual things to her without touching her,” Leavitt wrote in his report.

Leavitt wrote that the victim hesitated telling police about the alleged assaults fearing how her mother would take the news. The victim eventually told her mother and headed to Salisbury police station but changed her mind. Leavitt then visited the alleged victim’s house where she told him of the incidents.

According to Leavitt, Poly was confronted by the victim, but he denied ever touching her, calling her a liar and punching walls. He eventually placed a realistic-looking airsoft pistol up against his lower chin. The alleged victim also told Leavitt that Poly asked her to lay beside him in bed “one last time,” which she didn’t understand what he meant.

As the interview continued, the alleged victim told Leavitt that she knew of another young teen girl who had been sexually assaulted by Poly.

“Based on the seriousness of the allegations, and involving at least two children under the age of 14, with the possibility of a continuation of criminal sexual behavior, I am requesting an arrest warrant against Christopher Poly,” Leavitt wrote in his report.

Later that day, Poly was arrested by officer Richard Dellaria at Gracie’s Bar and Grill on Broadway.
