DETROIT (AP) - A state lawmaker from Detroit is scheduled for trial in December on assault and other charges.

Sen. Virgil Smith is accused of destroying his ex-wife’s Mercedes-Benz with gunfire. Anistia Thomas says she had resumed an intimate relationship with Smith but found him with a naked woman when she arrived at his home after midnight in May.

Thomas says Smith, a Democrat, punched her and pushed her out the door before firing shots, destroying the $35,000 car.

The Wayne County prosecutor’s office says Smith’s trial court arraignment was Thursday and a Dec. 7 trial was set. A pretrial conference is Aug. 27.

A judge earlier sent the case to trial. The other woman, Tatiana Grant, says she didn’t see Smith hit his ex-wife but she wasn’t wearing her contact lenses.
