LOS ANGELES (AP) - The California Supreme Court has overturned a life sentence for the getaway driver in a deadly Los Angeles holdup.

City News Service says the court ruled Thursday there was insufficient evidence to support a special circumstance allegation against Lovie Troy Matthews.

The case goes back to a lower court for re-sentencing but it’s unclear how much time Matthews will face.

Matthews was the getaway driver during the botched holdup of a medical marijuana clinic in 2008. A security guard was shot to death.

Matthews was convicted of first-degree murder.

However, the state Supreme Court said Matthews was in a car three blocks away during the killing and wasn’t a major participant.

Two other men are serving life sentences for the killing and a third is serving 45 years to life.
