CORPUS CHRISTI, Texas (AP) - A South Texas man could face execution after being convicted in the fatal shooting of a Corpus Christi convenience store owner during a robbery.
The penalty phase continues Tuesday for 27-year-old Daniel Garcia. A Nueces (nyoo-AY’-sis) County jury on Monday convicted Garcia of capital murder in the April 2014 slaying of 59-year-old Mostafa “Ben” Bighamian.
Garcia testified that he was smoking synthetic marijuana and decided to rob the store because he ran out of drugs and needed money.
Police found the victim while responding to a robbery call. Bighamian died later at a hospital.
Jurors could also opt for life in prison without parole for Garcia.
