WINSTON-SALEM, N.C. (AP) - A Winston-Salem man sought to terminate his caregiver nearly three weeks before police say he was charged in connection with her death.

The Winston-Salem Journal reports (https://bit.ly/1K81Hml ) court documents show 60-year-old David Darrell Thomas filed a petition with the Forsyth County Clerk of Court, seeking to have 72-year-old Ruby Duncan Johnson removed as his guardian. A hearing on the petition was scheduled for June 23.

On Thursday, Thomas was arrested and charged with first-degree murder.

Police say Thomas assaulted Johnson, resulting in her death.

Court documents say the two lived together and Johnson was appointed as Thomas’ caregiver.

Thomas is being held in the Forsyth County Jail without bond. He is scheduled to appear in court July 9. It was not immediately clear if Thomas has hired an attorney.
