ST. GEORGE, Utah (AP) - The wife of a man killed in a Utah crash is suing a third party as the driver accused of being distracted faces a homicide charge.

The Spectrum newspaper reports (https://bit.ly/18g0I4e ) that Leslee Henson filed a lawsuit in March claiming Fred Konrath was negligent in the fatality.

Henson was severely injured in the March 2013 crash and is now an advocate against distracted driving.

Henson was walking on the sidewalk with her husband, David, when Konrath’s vehicle plowed into them.

The lawsuit claims Konrath improperly changed lanes and didn’t see the vehicle Carla Lynn Brennan was driving behind him.

Brennan has denied that she was texting while driving when she struck Konrath’s car and pushed it into the Hensons.

Brennan’s criminal trial is pending.
