IDAHO FALLS, Idaho (AP) - An eastern Idaho judge has dismissed one of four counts of felony misuse of public funds against Jefferson County Sheriff Blair Olsen.

The Post Register reports (https://bit.ly/1EErFHS) that 7th District Judge Gregory Moeller dismissed the count because the statute of limitations of five years has passed since the National Rifle Association lifetime membership purchase in 2007.

Olsen still faces three counts from a Jan. 26 grand jury indictment accusing him of using county money to pay for his wife’s cellphone from 2010 to 2012.

Olsen in February pleaded not guilty.

He faces up to 33 years in prison if found guilty of the three remaining charges.
