THIBODAUX, La. (AP) - A Thibodaux city councilman facing a 30-day jail sentence for violating federal probation says he will not resign from office.

“I do not intend to resign my position over a misdemeanor hunting citation.” Chip Badeaux said in an email. “I do intend to continue to be vigilant of problems of my citizens.”

Chip Badeaux tells The Daily Comet (https://bit.ly/1ESti7t) out of the more than 50 emails and phone calls he recently received from constituents, not one has asked him to resign.

On March 10, Badeaux, 67, pleaded guilty in federal court to hunting ducks with lead shot on opening day and violating a three-year federal probation that included a hunting ban, according to the state Department of Wildlife and Fisheries.

Badeaux was fined $560 for hunting with lead shot and sentenced to 30 days in jail for violating a three-year hunting probation imposed after he shot and killed more than 50 ducks near Dularge in 2011, officials said.

Badeaux is expected to report to federal prison by April 10.

City Attorney Beau Brooks said he reviewed the city’s Home Rule Charter and did not find any rules regarding the jail sentence or misdemeanors that would prevent Badeaux from serving in office.

Last week former Councilman Eddie Hebert called for Badeaux’s resignation during the City Council meeting.

“Mr. Hebert, I’m going to say this in public even though the meeting is still going on, you’re an (expletive) for coming up and doing this, buddy,” Badeaux said. “I mean a real (expletive).”

Badeaux said he plans to apologize for the “discourteous and inappropriate choice of words.”

So far no sitting council members have called for Badeaux’s resignation
