NORRISTOWN, Pa. (AP) - A judge has declined to dismiss a first-degree murder charge against a southeastern Pennsylvania accused of having stabbed his wife to death.

The (Pottstown) Mercury (https://bit.ly/1Cxg9SR ) reports that Montgomery County Judge Steven O’Neill on Wednesday rejected the request from 38-year-old Walid Mitwalli of Hatfield Township.

Defense attorney John McMahon Jr. had argued that prosecutors failed to present enough evidence to support the charge in the June 2013 slaying of Mitwalli’s 30-year-old wife, Mona.

McMahon argued that there is no evidence that the slaying was intentional or premeditated and suggested that the crime is more akin to manslaughter. He has also indicated that he may raise a mental infirmity defense on the part of his client.
