BUTTE, Mont. (AP) - A new trial for a 25-year-old man accused of beating his father to death in 2008 has been set for Sept. 8 in Butte District Court.

The Montana Standard in Butte reports (https://bit.ly/1cLwM33 ) that Judge Kurt Krueger declared a mistrial April 16 for Adam Hatfield after jurors deadlocked. The county attorney’s office immediately filed to retry the case and the new date was set at a hearing Monday.

Butte-Silver Bow County prosecutors say Hatfield killed 49-year-old Matt Hatfield with a baseball bat, which he tried to burn.

The case went cold until a grizzly bear researcher discovered a skull north of Butte in 2010. DNA testing matched it to blood found in Matt Hatfield’s cabin and on the bat.

Defense attorney Randi Hood says the bat may have been the murder weapon, but her client didn’t use it.
