NEW YORK (AP) - A suspect is in custody in a fatal shooting near Manhattan’s Penn Station.

Police say the gunman who killed one man and wounded two others on Monday was taken into custody early Thursday. Charges against him are pending.

Police said earlier that the three victims were at a McDonald’s on Eighth Avenue when the gunman engaged them in a brief conversation, left the restaurant and then waited for them to exit.

Police said the gunman fired four shots at the men near the entrance to the subway station at 35th Street.

A 43-year-old man shot in the neck was pronounced dead at the scene. The two other victims were hospitalized.

The McDonald’s where the men were approached has become a gathering place for addicts who attend nearby substance-abuse programs.
