IPSWICH, Mass. (AP) - A lawyer for one of the men charged in the 2011 slaying of an Ipswich restaurant owner has urged a judge to toss as evidence a baseball cap found at the crime scene that contained a suspect’s DNA.
The Salem News reports (https://bit.ly/1MJunm4 ) attorney Lawrence McGuire cited reports showing the state police crime lab analyst who handled the cap later failed proficiency tests in blood spatter and handling trace DNA. McGuire represents 37-year-old Sifa Lee.
Salem Superior Court Judge David Lowy says it’s unlikely he’ll grant the request.
Lee and 50-year-old Cheng Sun are set to stand trial in the killing of Shui Keung “Tony” Woo. The 62-year-old victim was found tied up and bludgeoned.
Prosecutors believe it was a failed effort to get him to reveal the combination of a safe.
