WATERLOO, N.Y. (AP) - A former upstate New York village judge faces sentencing for falsely claiming he had been knocked over the head with a toilet tank lid and choked as he was locking up after work two years ago.

The highest sentence former Waterloo Village Judge Roger Barto could receive Tuesday is 2 1/3 to seven years in prison.

A Seneca County jury convicted the 53-year-old Barto in August of insurance fraud, defrauding the government, falsifying business records and falsely reporting an incident.

District Attorney Barry Porsch says Barto’s nine-day hospital stay cost the county more than $41,000. He said Barto is believed to have made up the story to get prescription painkillers.

Barto was suspended with pay after his indictment and removed from office with the conviction.
