CHARLESTON, W.Va. (AP) - The West Virginia Supreme Court has refused a petition in which a Republican lawmaker contended that the Common Core educational standards are illegal.

The state’s high court filed a unanimous order refusing the petition by state Del. Mike Folk of Berkeley County.

Folk has contended that the standards violate state law and the U.S. Constitution, which requires congressional approval of agreements between states.

He originally filed a similar lawsuit in Berkeley County Circuit Court.

Republican state Senate President Bill Cole is advocating for Common Core’s repeal as a 2016 gubernatorial candidate.

A push to end Common Core in the GOP-led Legislature died during the legislative session earlier this year.
