PORTLAND, Ore. (AP) - A Multnomah County judge has declared a mistrial for two men accused of murder and arson.

KOIN-TV reports (https://goo.gl/kozE4J ) that Ervin Oliver Golden Jr. and Mark Lyle Moore Sr. are charged with murder and arson following the death of 37-year-old Jeremy Purcell. Purcell was found dead when Portland Fire and Rescue responded to a garage fire in February 2013.

Golden’s attorney says the mistrial was declared when prosecutors revealed they had a new witness in the case, an insurance investigator who investigated the fire before a claim was paid. The attorney says he had no idea the witness existed until the prosecutors said so in court.

Defense attorneys say there is no physical or forensic evidence of arson.

A new trial date will be selected Oct. 6.
