LOS ANGELES (AP) - A state appeals court says a man who alleges he was mistaken for someone else, wrongly arrested and then sexually assaulted at the Los Angeles County jail cannot hold a prosecutor liable.
A division of the 4th District Court of Appeal said Tuesday the prosecutor has absolute immunity against the man’s claim of false imprisonment.
The man said Palm Springs police officers mistook him for a wanted parolee when they arrested him in July 2011. He was held for days in jail, where he was assaulted by a cellmate.
The Associated Press does not name victims of sexual assault. An after-hours call to the man’s attorney was not returned.
The man said the prosecutor could have secured his release earlier, but failed to determine his true identity.
