ORLANDO, Fla. (AP) - A 19-year-old man has filed an excessive force lawsuit against the city of Orlando, claiming a police officer hit him and kneed him in the stomach during an arrest.

Ryan Diaz filed the lawsuit Thursday in federal court in Orlando.

The lawsuit claims Officer Michael Napolitano violated Diaz’s First Amendment rights by trying to grab a cellphone that was used to video the encounter.

The lawsuit says Diaz was with two friends in downtown Orlando last July when Napolitano stopped them based on a complaint called into police that they were trespassing and smoking marijuana.

Their attorney says they were merely trying to get out of the rain.
