MOUNT VERNON, N.Y. (AP) - New York’s attorney general will not take over the probe into the death of a Mount Vernon bystander accidentally shot by an NYPD officer during an undercover gun and drug sting.

A spokesman for Westchester County District Attorney Janet DiFiore says Attorney General Eric Schneiderman and DiFiore agreed Tuesday that the case should remain with DiFiore.

The Journal News (https://lohud.us/1hTtXzo ) says Schneiderman’s office confirmed the decision.

Authorities say the victim, Felix Kumi, was standing behind the armed suspect in the street when he was shot.

It happened as the officer tried to purchase an illegal gun as part of the sting operation in the Bronx.

Three suspects have pleaded not guilty to drug and weapons charges in the case.
